Marcus is an Associate in our specialist litigation and arbitration practice, assisting senior members of the firm and outside counsel. He joined Lindsay & Francis in 2021 after completing his LLB and BA (Criminology and International Relations) at Victoria University of Wellington. Marcus has previously clerked for barristers in both criminal and civil practice, and has been involved in complex commercial disputes, regulatory investigations, trust litigation and criminal trials in the District and High Courts. Marcus is of Ngaati Maahanga descent.

    • Complex property development litigation: Assisting in the representation of a primary participant in a complex property development in litigation seeking tens of millions of dollars in compensation as a result of the failure of the project and subject mortgagee sale and related steps.

    • Company breakdown in creative sector: Assisting in the representation of an internationally renowned creative and related company in a complex shareholder dispute arising from a significant creative project and associated intellectual property right concerns.

    • Insurance company liquidation: Assisting in the representation of a Samoan insurance company and director in one of the largest liquidation proceedings in Samoan history.

    • CBL Corporation Shareholder Class Actions: Assisting in the representation of four former directors of CBL Corp in two parallel shareholder class actions proceedings, funded by separate third party litigation funders, arising out of the $747m collapse of Dual NZX and ASX-listed re-insurance company, CBL Corporation.

    • CBL FMA Proceedings: Assisting in the representation of four former directors of CBL Corp in proceedings brought by the Financial Markets Authority alleging breaches of continuous disclosure obligations and fair dealing requirements under the Financial Markets Conduct Act.

    • CBL Insurance Director Duties Proceedings: Assisting in the representation of four former directors of CBL Corp in proceedings brought by the liquidators of CBL Insurance alleging breaches of director duties.

    • Commercial leases: Assisting a leading commercial landlord in various matters to enforce leases over commercial premises and related enforcement proceedings.

    • International licensing rights: Advising an international company in regard to its rights under international licensing agreements.
